Hesse: shonky court ruling
The constitutional court of the federal state of Hesse had to decide about the constitutionality of the tuition fees in the state today. Remember: The constitution of Hesse (Article 59) declares education at all levels (including higher education) as »free of charge«. This has been subject to a complaint in front of the constitutional court. Today’s decision has been a controversial one: 5 out of 11 judges voted against the decision to accept the tuition fee law as constitutional.
Comments of almost all political actors have been saying that the decision has been a political one. The decision by the judges was led by their political party background, reflecting the majority situation in the parliament before the last elections. The parliament of Hesse had just decided to abolish the law, after the last elections led to new majorities for this aim. Due to the hung parliament, no new government has been elected right now. The acting prime minister Koch vetoed the abolishing law, mentioning lack of form. The anti-tuition fee majority in the parliament wants to solve this now in a extraordinary meeting. This flip-flopping provides an unstable situation to the students, who right now still do not know whether they have to pay fees in the upcoming academic year or not.
Hesse: tuition fees abolished
The first federal state in Germany, Hesse just abolished the tuition fees, which have been introduced one year ago. The federal state parliament decided today to start the upcoming academic year without the fees. Since last year, students had to pay 500-900 EUR per semester for their studies. The last elections changed the political majority in the state and enabled today’s decision.
Hesse is the first federal state that abolished its fees. Six out of 16 federal states now remain with fees starting from the first semester. Almost all other states have fees or other forcing regulation regarding so called »logn term« students. The change in Hesse in far important for the ongoing debate about tuition fees in the whole country. Statistics from the last semester showed that students mostly moved to states without fees.
One questions remains open. Since the constitution of the federal state forbids any kind of fees for education, students filed a suit against the tuition fees law. The decision of the court will now focus on the paid fees. The decision will make clear whether the universities have to pay back the fees of the past.
festival contre le racisme
fzs – the national student union in Germany is helding the festival contre le racisme during these days. From June 2nd – 8th, 21 student unions in Germany organise events and activities regarding »borders«. The festival aims to discuss the situation of international students, racism and discrimination inside and around higher education.
This year is the fifth year of the festival, which originated from a campagne of the French student union UNEF.
Geschichtsrevisionismus reloaded
Erika Steinbach (CDU), besser bekannt als Vorsitzende des Bundes der Vertriebenen, sollte gestern Abend einen Vortrag an der Universität Potsdam halten. Die Veranstaltung war der Auftakt zu einer Reihe zum Thema »Siedlungsgeschichte der Deutschen in Ostmitteleuropa«, die das Historische Institut als wissenschaftliche Vortragsreihe verstanden haben möchte. Steinbach hat in der Vergangenheit mehrfach gezeigt, welches Verständnis sie von der »Siedlungsgeschichte« der »Deutschen« hat. So stimmte sie als Mitglied des Bundestages gegen die Anerkennung der deutsch-polnischen Grenze und gegen die deutsch-tschechische Aussöhnungserklärung. Unbekannt ist auch keineswegs die geschichtsrevisionistisch anmutende Aktivität des »Bundes der Vertriebenen«. Das Konzept der »Heimat« basiert auf einem völkischen Denken, in dem die Ideologie von Blut und Boden das Recht auf Besitz konstituiert. Damit einhergehend werden TäterInnen und Opfer des Nationalsozialismus als »Vertriebene« definiert und in geschichtsverfälschender Weise verklärt.
Durch den klaren Protest von Potsdamer Studierenden konnte die gestrige Veranstaltung verhindert werden. Gleichzeitig war auf dem Potsdamer Campus ein massives Polizeiaufgebot zugegen, um gegen die protestierenden Studierenden vorzugehen. Einige Studierende wurden dabei verletzt. Besonders pikant: Die Polizei wurde nach Angaben des AStA von Professoren angefeuert, doch mal »draufzuhauen«. Einer der Professoren war angeblich der Staats- und Völkerrechtler Prof. Dr. Eckart Klein, Leiter des Menschenrechtszentrum der Universität Potsdam.
UPDATE
Die Hochschulleitung hat im Nachgang der Proteste die weiteren Vorträge vorerst ausgesetzt. Als Reaktion darauf hat Steinbach die weiteren Veranstaltungen ihrerseits abgesagt, da die Hochschulleitung keinen »störungsfreien Verlauf« garantieren könne.
